General rental conditions
Article 1: Purpose of the agreement
These general rental conditions aim to establish the terms for renting electrically assisted bicycles (hereinafter referred to as “EABs”) and any accessories (hereinafter referred to as “Accessories”) through a rental agreement concluded between SAS Velobourso, (14 rue de la duchesse d’Uzès, 51480 Boursault. Legal representative: Antoine Jacquinet. Siret number: 940 131 154 000012), (hereinafter referred to as the “Lessor” or “SAS Velobourso”) and the customer (hereinafter referred to as the “Renter”).
Article 2: The renter
To use the rental agreement, the signatory must be of legal age, declare themselves fit to ride a bicycle, and have no medical contraindications.
Except for the renter, no one else is authorized to use the e-bikes and accessories.
Article 3: Rental conditions: reservation, payment, prices, duration, deposit, availability.
A: Reservations:
The renter can make a reservation via the website of the Champagne Landscapes tourist office (in which case, after accepting Vélobourso’s general terms and conditions, the renter must pay their basket online with a credit card via the secure payment platform) or at the rental location (via bank transfer, a payment link, or in cash).
In case of cancellation by the renter:
– the day before the start of the rental period, SAS Velobourso reserves the right to charge cancellation fees of 50% of the total reservation amount.
On the day of the rental, SAS Velobourso reserves the right to charge cancellation fees of 100% of the total reservation amount.
No cancellation fees will be charged if the cancellation is due to a properly documented illness of the renter, or in case of unfavorable weather conditions (wind gusts exceeding 60 km/h, rain or snowstorms), or a case of force majeure as defined in articles 12-18 of the French Civil Code.
In case of online payment, the refund will be processed directly by SAS Velobourso via bank transfer, after verification of compliance with the above conditions.
B: Rental/Payment conditions/Payment methods:
The renter goes to the rental station (14, rue de la Duchesse d’Uzès, 51480 Boursault) and signs a rental agreement, acknowledging that they have read and accepted the general rental conditions.
When signing the agreement, the renter provides the required documents (valid ID or passport) and pays a deposit (see below).
Payment for the rental is made by credit card if the reservation was made online via the Champagne Landscapes tourist office website (full payment). Payment can also be made on-site at the Vélobourso rental station if the reservation was made there.
Similarly, all other amounts due under the rental agreement (deductible, any extensions not paid at the start of the rental, repairs, etc.) are due upon return, also by credit card, payment link, or cash.
Upon return of the electric bikes and accessories, an inventory is made and jointly signed by SAS Velobourso and the renter.
C: Rates:
SAS Velobourso makes one or more electric bikes and associated accessories available to the renter at the rates applicable on the day of signing the rental agreement. These rates are listed on the website www.velobourso.fr
and at the rental point (14, rue de la Duchesse d’Uzès, 51480 Boursault), and depend on the time slots as defined on the website.
D: Rental period / Return:
The renter must return the electric bike(s) and accessories to the departure point on the date and time specified in the rental agreement. If the renter wishes to extend the rental period or change this date, they must notify SAS Velobourso and obtain prior approval.
No refund will be given if the Renter returns the e-bike(s) and Accessories before the planned end date of the rental period.
In case of late return, a penalty equal to one day’s rental per day of delay will be charged.
The equipment must be returned in working order and in reasonably clean condition. SAS Velobourso reserves the right to charge the renter for any repairs needed due to damage to the equipment.
E: Deposit:
As a guarantee for the proper fulfillment of their obligations, the renter must pay a deposit of €500 (five hundred euros) per e-bike to SAS Velobourso. This deposit can be paid by credit card, bank check, payment link, or cash. During the rental period, a valid ID must be left. Copies are not accepted; the name on the credit card and the ID must match.
This deposit is not collected during the rental period.
After returning the rented items, the deposit will be refunded to the renter, minus any damages as described in article 7.
By mutual agreement, the deposit becomes the property of SAS Velobourso up to the amount owed by the renter in case of non-payment of a due amount. The renter authorizes the lessor to deduct the following amounts from the deposit:
As part of the deductible,
For repairs of damages and theft,
As compensation for late return of rented items.
It is expressly agreed that the amount of the deposit does not constitute a liability limit. The lessor reserves the right to claim full compensation from the renter for any losses incurred.
F: Availability:
To ensure better availability of the bikes, we advise you to submit your reservation request for an e-bike at least 48 working hours before the desired departure date to SAS Velobourso.
Article 4: Condition of the e-bikes and accessories, maintenance and repairs
The renter acknowledges receiving the rented item in good condition, including the basic equipment (helmet, vest, lock).
The renter agrees to return the rented item in the same condition as received, except for normal wear and tear.
The tires are in good condition and free of cuts. In case of damage to a tire, for any reason other than normal wear and tear, the renter agrees to replace it with a new tire of the same brand, with the same specifications and dimensions.
Any damage or remarks upon delivery or return of the e-bike(s) and accessories must be recorded in the rental agreement.
Routine maintenance of the e-bike, as defined in the manufacturer’s maintenance guidelines, is performed by a service provider of SAS Velobourso.
Repairs, replacement of parts, or tire changes due to normal wear and tear are the responsibility of SAS Velobourso and will be performed by them.
Repairs, replacement of parts, or accessories resulting from negligence or fault of the renter are always the responsibility of the renter.
In case of immobilization by the renter themselves, the renter must return the e-bike(s) and accessories to the rental station at their own expense, including removal and transport costs.
The rental period continues during this time, and all obligations of the renter remain in force.
Article 5: Conditions of use of the e-bike(s) and accessories
From the moment the electric bike(s) and accessories are made available, the renter has custody and full responsibility, including all consequences arising from their use.
The renter is solely responsible for traffic violations or other legal infringements committed during the rental period.
The renter is liable for any fines, penalties, and sanctions, and agrees to reimburse SAS Velobourso if the company has to pay them in advance.
The renter agrees to take all necessary precautions to prevent damage, theft, or fraudulent appropriation of the electric bike(s) and accessories.
In particular, the renter agrees to secure the bike to a fixed object when parking, using the lock provided by SAS Velobourso. The renter must use the bikes and accessories carefully.
The renter acknowledges receiving the electric bike and understands how it works, particularly regarding the instructions for charging the battery.
The renter agrees to comply with the following rules: carrying another person on the luggage rack is strictly prohibited. Baskets (if rented) are exclusively for small items, up to a maximum of 2 kg.
The renter agrees not to make any modifications to the electric bike(s) or accessories, nor to add anything to them.
The renter acknowledges that SAS Velobourso provides a helmet with each rented electric bike and strongly recommends adults wear it for safety reasons. SAS Velobourso cannot be held liable if the renter refuses to wear a helmet.
The electric bike(s) and accessories must not be used abnormally, including:

Off-road

For paid passenger transport

For subletting

For carrying a passenger (except a young child in an approved and SAS Velobourso-accepted child seat)

For transporting flammable, explosive, corrosive, oxidizing, radioactive substances, or radiation sources
The electric bike(s) and accessories must be returned in the same working condition as at the start of the rental, including tires in good condition. Otherwise, the repair costs will be charged to the renter.
If the renter wishes to transport the electric bike(s) and accessories themselves, SAS Velobourso disclaims all responsibility for the condition or safety of the bike after transport.
The renter must:

Article 6: Use, custody, and return of accessories
The installation and removal of accessories are performed upon pickup and return by SAS Velobourso.
From the moment the accessories are delivered, the renter has custody and full responsibility for the accessories and their use.
The renter agrees to take all necessary precautions to prevent damage, theft, or fraudulent appropriation of the accessories. The renter is responsible in case of theft, damage, or loss.
Accessories must be returned in the same condition as at delivery. Otherwise, the repair or replacement costs will be charged to the renter.
The rental period is for the period specified in the rental agreement. No refund will be given for early return.
Article 7: Liability – Damage to rented goods – Theft
The renter is personally liable for damage occurring during the use of the e-bike(s) and accessories. SAS Velobourso is not liable for damage caused by or to the bike(s) and accessories, unless proven to result from an internal defect or maintenance error.
The renter declares having liability insurance (or equivalent insurance for non-French residents) covering liability arising from the use of the rented goods.
In case of damage: the renter must return the damaged equipment, which must be complete and identifiable. Damage will be invoiced to the renter.
In case of theft or loss: theft and loss are not covered. The renter will be charged the replacement value based on the new price, minus depreciation (20% per year). The deposit will be used to cover the costs in whole or in part.
An invoice will be issued, which the renter may submit to their insurer.
Article 8: Obligations in case of accident or theft
The renter agrees to notify SAS Velobourso as soon as possible, and within 24 hours of the incident, of any incident.
The renter further agrees:
a) In case of an accident, to send SAS Velobourso a fully completed and legible damage report within 48 working hours (or, in its absence, a detailed written statement of the incident, with contact details of all involved parties and witnesses, and a description of the damage).
b) In case of theft or vandalism, to report it immediately to the police and provide SAS Velobourso with a police report within 48 working hours.
If theft occurs in a vehicle, the renter must file a claim with the vehicle’s insurance company and provide a copy of the claim and the vehicle’s insurance policy to the intermediary.
Article 9: Assistance from the lessor
The renter rents the e-bike in perfect condition and is responsible for returning it to the original rental point.
In case of breakdown or an incident due to manufacturing or maintenance issues, the renter may, however, receive free assistance from SAS Velobourso to return the bike to the rental point.
This assistance is provided by a service provider and is limited to roads accessible to motor vehicles within a 20 km radius of the rental point (14 rue de la duchesse d’Uzès, Boursault).
Article 10: Consent for the publication of photos
During the rental period, photos of renters may be taken.
The renter is informed and agrees that photos featuring them may be published by SAS Velobourso on its website or on social media platforms (Facebook, Instagram, TikTok, etc.) for promotional purposes.
Renters who do not wish their photos to be published must notify SAS Velobourso before or after the rental period via email to: antoine.velobourso@orange.fr
Article 11: Data protection (Informatique et Libertés Law)
In accordance with Law No. 78-17 of January 6, 1978, as amended by Law No. 2004-801 of August 6, 2004:
1°) The renter’s personal data may be used for surveys, analysis, or commercial operations by SAS Velobourso.

Article 12: Disputes and jurisdiction
Any dispute relating to the interpretation or execution of this rental agreement is subject to French law.
Under article L.612-1 of the Consumer Code, “every consumer has the right to refer a dispute with a professional to a consumer mediator free of charge.” This means you can contact AME CONSO via www.mediationconso-ame.com

If no amicable settlement is reached, disputes will be submitted to the competent courts of Reims, where the statutory seat of the lessor is located.
